THE CONTRACT
  1. Little Escapes hereafter referred to as 'The Agent' offers a reservation service for holiday accommodation,ferry travel, and holidays including Air Travel. The air holidays shown on this website are ATOL protected by the Civil Aviation Authority. Our ATOL number is T7250. ATOL protection extends primarily to customers who book and pay in the United Kingdom. Click on the ATOL logo if you want to know more. The aforementioned items are offered for sale to the General Public hereafter referred to as 'The Client'.
  2. All payments for accommodation and/or holidays including ferry travel and holidays including ATOL protected air travel by charter/itx flights will be deposited into the Trust Account operated by TTA Trustees [UK] Ltd, cheques must be made payable to ‘Little Escapes Trust Account’.
  3. Financial Protection - We are licensed by the Civil Aviation Authority and hold ATOL Number T7250. This ensures that in the event of our failure your money will be protected; if you are on holiday at the time, arrangements will be made for you to complete your holiday and return home. The flights we advertise are suppled by other ATOL holders and are protected by their bonds. For further information, visit the ATOL website at www.atol.org.uk.
  4. Payment for your Flight - The payments you make for your flight are held by us [in our trust account] on behalf of the ATOL holder who is supplying your flight, until the date we pass the money to that ATOL holder. The ATOL holder supplying the flight will issue an ATOL confirmation invoice to confirm its contract with you.
  5. The sale of seats for *low cost budget airlines, is not ATOL protected and does not form part of a package. We can reserve this type of flight on your behalf, however by asking us to do so you are aware that the contract for such a request is strictly between the low cost budget airline and you, the client. Any payment for a low cost budget airline is payable direct to the airline and their terms and conditions apply. This element is completely outside of the scope of any bonding provided by the TTA or ATOL and should the airline fail to provide the travel you have booked for any reason, the contract is clearly between the airline and you, the client. In this case the client will be informed of the above by the agent
  6. Once any booking is made firm through payment details being supplied verbally or otherwise by the client to the agent, a contract is in place between the client and the agent [*Excluding low cost budget airlines where the contract is between the airline and the client, see above]. By making a firm booking you the client, are agreeing to our terms and conditions as well as the booking conditions of the property/travel reserved. A confirmation invoice will then be issued and it is the responsibility of you as the Client to check all the details are correct including any special requests and to notify the agent of any discrepancies within 48 hours of receipt or before the date of travel whichever is earliest.
  7. All clients will be covered by a Fidelity Insurance Policy issued by The agent which covers each passenger up to £11,000 in the event of failure by the The Agent
  8. The agent cannot be held responsible for any discrepancies arising through errors in descriptions of properties or for discrepancies or cancellations arising as a result of any travel, car hire, accommodation or insurance arrangements made through any third party links from the site or otherwise
  9. All clients are strongly advised to take adequate travel insurance to cover any cancellation charges applied as a result of unused accommodation, whether through being unable to take the accommodation as a result of cancelled travel arrangements due to bad weather, via travel reserved by air or sea by the agent or otherwise.

PROPERTY RATINGS
  1. All property ratings shown using the deckchair symbol, are only an indication of the local grading and this is not an official AA star or other star rating. The official rating if applicable will appear in the description.

THE RESERVATION
  1. In order to offer you the most up to date 'live' availability all properties are on a request basis. Once your enquiry form is submitted through the website or you request we check availability verbally, we will contact you to confirm the availability either by email or by telephone. A deposit of £50 per person per week is payable in order to confirm a reservation which is firm once payment details have been supplied to the agent verbally or otherwise, full pre-payment is due 8 weeks before arrival, in the event we do not receive the balance when requested, we reserve the right to cancel the holiday/services booked. The reservation is subject to the terms and conditions of The agent and Booking Conditions of the property being reserved. Cancellations must be made in writing by post, email or fax to The agent, cancellation charges if applicable will be applied from the day the cancellation is received in writing by The agent. Should any accommodation or car hire or travel be cancelled due to any force majeure or bad weather, cancellation charges will still be applied and clients are strongly advised to take adequate travel insurance to protect and cover such possibilities.
  2. Should any accommodation request be declined, we will try to offer alternative accommodation of a similar standard. It is the responsibility of the client to settle any extra charges incurred during their stay for any other extra services not provided on the invoice by The agent, as per the policy of the property or car hire company concerned.
  3. If a change of property, travel arrangement, outbound travel date, return travel date or duration is requested by the Client after a reservation has been made firm, we will try to accommodate your changes but cannot guarantee. Cancellation charges may apply as per the Booking Conditions of the property or travel provider concerned, in addition to an admin/handling charge of £25 plus any increase in fare on travel arrangements.
  4. In the event of the original property being unable to accommodate a confirmed booking due to overbooking or otherwise, The agent will find alternative accommodation of the same standard or provide a full refund.
  5. All confirmations are issued by The agent as under the conditions and regulations of the companies supplying the service.
  6. The agent makes all statements and gives all information in good faith and endeavors to check, so far as it is reasonably able, all information given to clients. The agent shall not be liable for any inconvenience, damage or loss resulting from information given or statements made whether orally or in writing provided that such information is given or statements made in good faith.
  7. These terms and conditions may not be varied or waived except in writing by The agent. Any questions, matters or disputes arising out of any agreements shall be governed by the laws and customs of Jersey. If in the opinion of the Client, the accommodation provided by The agent is unsatisfactory and there are solid grounds for complaint, the client must bring his complaints first to the notice of the Manager of The Property, the client must also notify The agent in writing within 14 days of the return date. All written complaints will be acknowledged in writing within 7 days of receipt by the agent. A response to the complaint will be provided in writing within 14 days of receipt of the complaint by The Agent.
  8. The number of persons occupying the accommodation must not exceed the number arranged at the time of bookingCheck in and Check out times are subject to the terms of the property.

CAR HIRE OFFERED THROUGH A THIRD PARTY
  1. All car hire charges including mandatory charges of collision damage insurance, local government license and fees where applicable and petrol are payable direct to the car hire company either at the time of booking where applicable or upon collection of the car as per the terms and conditions of the car hire company. This part of the booking is not covered by TTA membership. All extra charges will be advised to the client before booking and are shown clearly on the car hire confirmation voucher. It is the responsibility of the client to check their confirmation details are correct and notify the agent within 48 hours of receipt of the confirmation or before the date of travel, whichever is earliest.

SPECIAL REQUESTS
  1. Special requests and requirements must be advised at the time of enquiry, although we will try to meet these requests where possible, they cannot be guaranteed and are at the discretion of The Property.

INSURANCE
  1. We strongly recommend all clients are insured for their visit. Travel Insurance will be made available at an extra charge to all clients booking a holiday or accommodation through the agent. It is the responsibility of the Client to check all policy wording and that all the details of passengers covered under the policy are correct and to notify the agent within 48 hrs of receipt of any discrepancies.

TRAVEL OFFERED THROUGH A THIRD PARTY, VISA AND HEALTH
  1. It is the responsibility of the Client to ensure all their travel details are correct as per the terms and conditions of the airline booked either through links from the Little Escapes Website or otherwise. It is the responsibility of the Client to ensure they have photographic identification for all flights and where necessary have arranged visas and hold the correct validity on their passport and to check with the relevant local authorities as to the latest requirements. It is the responsibility of the Client to check where necessary that all health precautions both compulsory and non- compulsory are adhered to and advice taken from their local GP.

EXTRA ACCOMMODATION CHARGES
  1. Some properties have additional service charges. Where mandatory, these will be stated clearly in The Accommodation Providers booking conditions where applicable and it will be clearly stated where mandatory charges are included in the rates or not.
PRE-PAY DISCOUNTS & ADMIN CHARGES
  1. Choose the pre-pay in full option at the time of making your reservation and we will discount your booking by £10, discount option only applies to new bookings made after 5th Sep 2007 where travel commences minimum 70 days or more from the date of booking. Changes made after any booking has been confirmed will be subject to a £25 admin charge. We charge a £10 per person Booking Fee for Air travel bookings.
